EPHRAIM — A man who asked to use a neighbor's bathroom has been arrested and now charged with instead wandering into the bedroom of a young girl and attempting to sexually assault her.

Javier Abraham Rasco Estrada, 19, was booked into the Sanpete County Jail on Sunday and charged Tuesday in 6th District Court with attempted rape of a child and burglary, second-degree felonies; and drug possession, a class A misdemeanor.

On Sunday, police say Estrada went to a residence in Ephraim, close to where he had been staying, and asked the homeowner for permission to use the restroom.

But "instead of using the restroom, he entered a child's bedroom and laid in bed with a female child. The male was lying next to her hugging her and touching her face; he was also talking to her asking her sexual questions. When the child woke up and realized what was going on, she pushed him away and ran out of the room," a police booking affidavit states.

The girl's father, who was outside, went into the house because Estrada was taking too long to use the restroom, and saw "his daughter came running out of her room crying and locked herself in the bathroom," according to the affidavit.

Estrada was located by police a short distance away. He admitted to drinking the previous night and that morning, as well as using drugs, the affidavit states.

The girl, who is under the age of 12, told police "that she was scared, trembling, and nervous that Abraham would do ugly things to her." When questioned by detectives, Estrada said "he had entered the victim's bedroom to test if she was interested in having relations or sexual contact," the affidavit alleges.

"It was understood that Abraham had permission to enter the home to use the restroom. But we were informed he went in and used the restroom and went back outside. I was informed a short time later he went back into the residence to use the restroom again and this is when he entered the girl's bedroom," police said in the arrest report.

Police say Estrada has only lived in Utah for about a month.
