Defense attorney 'shocked' by jury's verdict for driver who hit 2 pedestrians in Hurricane

ST. GEORGE — The jury returned a verdict in the case against the driver charged with felony DUI following a crash that injured two teenage girls when they were struck by a pickup truck on State Street in Hurricane in November 2021.

A three-day trial for the case against David Chad Garner began Feb. 24 at 5th District Court in St. George and was presided over by District Judge Keith C. Barnes. The jury found him not guilty of the felony DUI charge. They did find him guilty of the two traffic infractions: failing to yield to a pedestrian and the windshield violation.

Just before the jury entered the courtroom on the first day of trial, Garner pleaded guilty to a charge of a driving on a suspended license, which was reduced from a felony to a misdemeanor.

On the morning of Nov. 23, 2021, emergency personnel responded a crash reported at the intersection of State Street and South 300 West in Hurricane where two teenage girls were struck by the pickup truck Garner was driving as they crossed State Street, as previously reported by St. George News.
