11-month-old left in hot car by intoxicated father, police say

CEDAR CITY — A man who police say got really drunk, passed out and left his young son inside a hot car with the windows rolled up has been charged.

Cody Oshley was charged Tuesday in Iron County's 5th District Court with 13 felonies and misdemeanors, including two counts of assault by a prisoner, two counts of assaulting a police officer, propelling a substance at an officer, child abuse, two counts of assault, domestic violence in the presence of a child, interfering with an arrest, disorderly conduct and intoxication.

According to a probable cause statement, Oshley had been "consuming a large amount of alcohol" Saturday when he went for a drive with his 4-year-old and 11-month-old children in the car. When he returned home, he took the 4-year-old inside but left the 11-month-old in the vehicle with the windows rolled up, according to court records.

The temperature that day was near 100 degrees, the charges state.

When the child's mother arrived at the home and asked where her son was, Oshley, who was passed out, stated "right there" and pointed to an empty floor, according to the charges. The woman then found the boy "pouring sweat from his little body" inside the car, according to the charges.

The woman decided at that point to pack her bags and leave, angering Oshley, who punched her in the back of the neck, according to the charges. Another man in the house wrestled Oshley to the ground and restrained him until police arrived. An officer handcuffed Oshley, who passed out again on the floor, the charge state.

While officers were checking Oshley, he opened his eyes, swore at and insulted officers, and kicked an officer "as hard as he could," according to court documents. As the officer tried to restrain Oshley's legs so he wouldn't get kicked again, Oshley spit on two officers, according to the charges.

Oshley continued to struggle, curse and threaten officers as they dragged him to the patrol car because he either couldn't or wouldn't walk, the charges state. He was taken to a local hospital, where his belligerent behavior toward police and hospital staff continued, according to charging documents.

Court records show Oshley was convicted of assaulting a police officer in 2008 and felony trespassing in 2007.
