OGDEN — A 19-year-old man who allegedly was expecting a fistfight has been arrested after police say he took out a gun and fired multiple rounds, killing one man and injuring his own brother.

Ricardo Caballero was booked into the Weber County Jail on Sunday for investigation of aggravated murder and two counts of discharge of a firearm.

Ogden police responded at 10:46 a.m. Sunday to a report of shots fired in the 700 block of 30th Street, according to a statement from Ogden police. Caballero called emergency dispatchers and said he was taking a gunshot victim to a local hospital, a police booking affidavit states. The victim, Caballero's brother, was admitted in critical condition.

"Officers obtained further information and learned the victim had been shot in a nearby area, and officers responded to that area and located another adult male victim who had sustained several gunshot wounds to the torso. The second male victim died at the scene as a result of the injuries," according to the affidavit.

When questioned, Caballero said he and his brother were going "to meet with another individual to fight them over a disagreement," the affidavit states. But when they got there, Caballero claims more people showed up to fight than he was expecting.

"Ricardo stated he never observed any of the other individuals with a weapon at any time, and they never made any threats involving a weapon of any kind. Ricardo stated one individual began to advance towards his brother, but never displayed any weapons and never made any threats indicating they were armed," according to the affidavit.

Caballero, however, pulled out a handgun and began shooting.

"Ricardo stated as he shot at the individuals near his brother, his brother cried out in pain, which made Ricardo realize he shot his brother," the affidavit states.

A second man was then shot multiple times.

"Ricardo made several inconsistent statements, first stating he shot towards an individual who was advancing toward him, then stating he actually shot towards the individual as he was trying to run away, then stated he actually only intended on firing 'warning shots' to attempt to scare the two individuals away from his brother," police wrote in the affidavit. "No shell casings from any other firearms were located on scene."

The name of the deceased man had not been released as of Monday.
